North Carolina Governor Roy Cooper may have lifted most of the COVID restrictions, but his Declaration of Emergency is still in force. As is an Executive Order. Which is which is why the owner of Club 519 in Greenville, NC is still litigating the constitutionality of his assumed powers under the Emergency Management Act. Jessica Thompson is an attorney with the Pacific Legal Foundation representing the bar owner in the case, and she joins me to discuss the latest developments.
