[00:01:02] Um, whether he should have been deported back to El Salvador from where he is from. Um, did he get due process? Um, should he have been deported? All of that. Federal judge yesterday blocked the Trump administration from revoking the legal status and work permits of more than 530 migrants from Cuba, Haiti, and

[00:01:32] Nicaragua. Nicaragua and Venezuela. Nicaragua and Venezuela who flew into the United States during Biden's time in office. So this is a separate issue or case, I should say. but oddly enough when you get in front of democrat judges they all rule the same way and no it's not because that's what the law says this guy who was ordered back to

[00:02:00] el salvador is from el salvador the problem was that he was not supposed to be sent to el salvador because there was one proceeding um that said he shouldn't go back to el salvador but he is deportable that's not the question he is deportable he was ordered deported just not to

[00:02:29] el salvador but they sent him to el salvador and the trump administration the government lawyers have said our bad on that we didn't yeah we didn't realize we sent him back to el salvador and so maybe they just say okay you know what um we'll send a plane down pick him up and uh we'll uh we'll send him to venezuela or to another country guy's name is kilmar sorry kilmar i thought it was kilmore

[00:02:59] a very dickensian name for the story anyway kilmar abrigo garcia he was an illegal alien found by the immigration courts to be subject to removal from the united states the courts have already told us that he is to be removed that's his due process that's the due process he went through

[00:03:21] the courts he has no right to return to america he has no right to remain in america he was ordered deported second all during this is the guy i think is this the oh he's a maryland dad the maryland man the maryland dad that's how they keep referring to this guy but he was also allegedly part of ms 13

[00:03:47] now i don't know how deep into ms 13 he was i don't know if he's got a whole bunch of the teardrops you know tattooed next to his eyeballs or whatever but during the removal proceedings and this is undisputed abrigo garcia was detained in the second or during the removal proceedings he was detained

[00:04:11] the initial detention was based upon a finding supported by evidence presented that he was a member of ms 13 the gang that finding was later then upheld by the bureau of immigration appeals

[00:04:34] that's due process much ink has been spilled in the past 10 days suggesting this finding was not supported by meaningful evidence but it does not work that way this is according to a lawyer for dozens of j6 defendants he goes uh on i forget his real name um i forgot to write it down um but his uh his twitter

[00:05:01] handle is shipwrecked crew and he's a he's a federal lawyer and he's pointing out that he had a hearing evidence was submitted a determination was made by the judge it was appealed it was upheld and by the way there is more evidence than the public has been led to believe because whatever

[00:05:27] happened inside that court proceeding i i don't know but people are being led to believe that is this i'm not sure was this the hairdresser the guy who was alleged oh he's just a hairdresser he's not ms 13 i think that might be the same guy but i guess i've i've lost track this army of left-wing lawyers has just descended on every single deportation case they can find and it seems like they're picking like

[00:05:52] the worst examples to to defend but whatever so after the guy goes through his proceedings right after being detained and then he's awaiting deportation he and his attorneys then seek three forms of relief three different efforts okay one he sought asylum to try to basically get the order

[00:06:21] of removal overturned an order of removal much as the name would lead you to believe is that you are ordered to be deported okay they are ordering you out okay so he tries to overturn this he seeks asylum he sought protection under the the convention against torture or the the cat or as i call it the cat

[00:06:46] and third effort was withholding of removal okay so those are three different avenues he and his lawyers tried to pursue in order to prevent him from being deported as he was ordered to to be the asylum claim rejected he had been in the country for seven years before he applied for asylum so they rejected that

[00:07:11] his claim under the cat under the convention against torture that too was rejected because he could not make any kind of a factual basis in 2019 that he had a fear of torture by the salvadoran government so that one was off the table and that leads us to the third and final effort which was the uh the withholding of removal request or the wor or as i call it the war

[00:07:41] that he was granted the wor is based on a fear of persecution if returned to one's home country but while asylum grants the right to remain in the u.s the relief under the wor is to not be returned to your own country but you still get deported that's what he won and so the mistake here for kilmore

[00:08:11] uh kilmar abrigo garcia the issue here is that he was deported to the wrong country because he went back to his home country and he had this wor which said you can deport him just not to his home country and the salvadoran president who just met with uh president donald trump yesterday said why why would

[00:08:37] i bring him back in why would i try to smuggle this guy back into your country i'm not going to do that he's an el he's a el salvadoran i don't know if he's got charges against him down in el salvador or not and also i'm not sure i believe his story about why he fears that you know this uh was a barrio 18

[00:09:00] gang uh rival salvadoran gang a rival gang to ms 13 that was trying to shake his mom down because she was selling food out of her house and they wanted a cut of her revenue and that they were gonna you know they were gonna kill him if she didn't pay or something that was his that that was the claim again i i don't have a lot of confidence in that claim because after seven or eight years living

[00:09:27] illegally in america and then throwing out all these different claims to try to avoid deportation failing in those claims it seems like this was just kind of a last ditch effort throw anything out there that you can see if you can get any kind of a ruling that was the most favorable thing that his lawyer could get for him which was fine we'll deport you but pick a different country rather than your

[00:09:49] home country and then there's the half a million migrants from cuba haiti nicaragua and venezuela that joe biden brought in that apparently donald trump is now not allowed to get out see you can be president apparently if you're a republican you just don't get any of the powers that the democrats get when they're in the office here's a great idea how about making an escape to a really special and

[00:13:12] legal status and work permits of the more than 530 000 migrants from cuba haiti nicaragua and venezuela do you remember this it was the program the chnv program which is a horrible acronym you got to have a vowel in there guys okay chnv or as i call it the chnv program and biden did this biden made this up

[00:13:41] much like obama made up daca which say what you want at least the acronym spells something that you could say right the deferred arrival deferred action childhood arrivals act right like that the daca thing for the dreamers so you know joe creates the chnv program via executive uh order in 2023

[00:14:10] 2023 the program was launched um in 2022 and initially first applied just to venezuelans but then he expanded it the next year to include the h uh the n and the c right the the chnv part of the chnv program and the administration back then argued that the chnv would help reduce

[00:14:38] illegal crossings at the southern border and that is true by the way it did because it flew them into the country thereby reducing the the border crossings at the ports of entry that was the point it was to juice the stats while continuing to aid in the mass invasion of people coming to the country which is

[00:15:04] what people do by the way when you operate you know a a colonizing racist misogynist xenophobic sexist country everybody wants to come here for some reason we are so awful at just a historical level america is so terrible that like everybody wants to come here for some reason i guess people just are

[00:15:29] gluttons for punishment but uh yeah so remember the program when biden did it was put on pause temporarily after widespread fraud was discovered in the program okay several recipients were also arrested for high profile crimes including multiple child rapes so yeah that's a i mean that's part of

[00:15:56] the problem when you just allow people to apply on you know an app and then get a free plane ride into america chnv allowed the migrants and their immediate families to fly into the u.s if they had an american sponsor which which was totally above board i'm sure nobody was gaming that system they could then remain in the

[00:16:24] country for two years under a temporary immigration status known as parole officials with the department of homeland security and the trump administration said that this judge who by the way who made this ruling is an obama appointee judge indira talwani that the judge essentially ruled that trump can't use

[00:16:49] his own executive authority the same authority biden used so biden used his authority to mass approve right hundreds of thousands of these parolees coming in from chn and v but trump says no you're getting out we're deporting you this program's over under the same executive authority and this judge is like oh no no that's different why is it different all right if you're listening to this show you know i try

[00:18:39] that she's an obama appointee and she has blocked president trump's administration from revoking the legal status for 530,000 illegal aliens who flew into the united states via the program joe biden created the chnv program which was an expansion of a program that he initially did on his own to allow

[00:19:06] venezuela to fly people into the country or us i should say to fly them into the country from venezuela which i'm not sure if you're aware of this or not they don't really like us very much they blame us for a whole bunch of their commie failures so like that didn't seem like a great idea and that's why when donald trump talks about how you know these countries are you know sending criminals

[00:19:32] and you know people out of the insane asylums that's what he's talking about so this judge says that every single one of these migrants needs to have an individualized case by case review you know like they got when they were flown in no they didn't see that's the problem they didn't they didn't in violation of the law they didn't

[00:20:02] to the point where the secretary of the department of homeland security alejandro mayorkas was impeached over it that's who we're this is what we're talking about this is the same program okay so chnva allowed migrants and their immediate families to fly into our country right officials with homeland security and the trump administration now say talwani the judge is

[00:20:30] essentially is ruling that trump cannot use his own executive authority the same authority biden used to revoke the parole that biden granted and the homeland security officials and administration officials are saying that because it's true because it's true in march the roughly 532 000 migrants under this program were told to leave the united states before their humanitarian parole

[00:20:59] and accompanying work permits are canceled on april 24th that gave them a month from when the notice is formally published on march 25th so they're still here they've been given a month to clear out let's go back a year ago a little bit longer than a year ago from april 30th 2024

[00:21:24] the house committee on homeland security revealed documents obtained through a subpoena of the department of homeland security and by the way they had to subpoena dhs because dhs wouldn't give them the documents home the house committee on homeland security sought the documents dhs didn't give them

[00:21:45] to them so they got slapped with a subpoena and the documents identified more than 50 airport locations that are used by dhs to help process into the country more than at the time 400 000 inadmissible aliens

[00:22:07] through the administration's unlawful chnv mass parole program this was a mass parole you do a mass parole then that means you can undo the mass parole that's my view on it if you're going to ignore the law that says hey you're supposed to do this on a case-by-case basis like that's really what we're talking about here is how do you unwind lawless behavior of an administration and i know people

[00:22:37] on the left and the anti-trumpers i know that they're going to say well we're going to have to do that when trump is out too which is the whole point of the problem trump is a symptom of this guys he's not the cause of it you allowed all of this you allowed obama to do it with the daca i have a phone i have a pen right you allowed that to occur nobody paid any kind of penalty for that so then they do it again and now trump comes in and says i'm gonna undo daca oh no no you can't do that all right i'm gonna

[00:23:06] undo the chnv no no no you can't do that so you can get elected president you just can't ever be president that's kind of what the judges are saying and i've said this repeatedly this does not stop the this kind of behavior from the district court bench this does not stop unless the supreme court rule reigns in the lower courts because if the supreme court won't do it if chief justice john

[00:23:33] roberts won't do it and i don't believe he will i don't think he's got the intestinal fortitude to do it what you are seeing is a judicial branch that is now viewing itself as not a co-equal branch of the government it's viewing itself as supreme that's a problem that is a problem if the judiciary thinks that it is above the other two branches particularly because one of those branches

[00:24:03] has guns they have the monopoly of on force you want judges making rulings and directing the people with the guns to go do stuff according to these documents dhs this is from a year ago dhs admitted that none of the individuals that were allowed into the country under this program have a

[00:24:32] legal basis to enter the country none of them they were inadmissibles they there was no legal basis for them to be here but they got paroled through the program dhs said quote all individuals paroled into the united states are by definition inadmissible including those paroled under the chnv processes

[00:24:58] so what to do what to do when you have half a million people admitted unlawfully they were flown in here by the biden administration at taxpayer expense flown into the country and they were never supposed to be allowed to enter let alone get paroled let alone get protected now the chairman at the time

[00:25:25] of the um house committee on homeland security mark green republican from tennessee said secretary alejandro mayorkas's chnv parole program is an unlawful sleight of hand used to hide the worsening border crisis from the american people implementing a program that allows otherwise inadmissible aliens to fly directly

[00:25:51] into the u.s not for significant public benefit or urgent humanitarian reasons as is required under immigration and national nationality act mandates has been proven to be an impeachable offense they subpoenaed um for the documents the house voted to impeach him but the senate utterly failed

[00:26:19] in its duty to hold a trial remember that i do i'm old enough to remember that it was like just a year ago so yes i remember that the democrat-controlled senate refused to hold a trial as they are required to do recognize where we are

[00:26:41] this is i like i understand there is a normalcy bias here you think oh we just disagree on this stuff and policy whatever no no no no we have been talking about the dismantling of this infrastructure by the left for a while now people are mad at donald trump he's going after people uh for tax-exempt status harvard university and all this stuff yeah

[00:27:07] cry me a river tea party people right well you're anti tea party people when when obama sick to the irs on the tea party you guys defended him in doing so recognize where we are and how we got here you guys keep dismantling the framework the infrastructure and then you cry that other people aren't adhering to the old rules

[00:29:31] according to the documents since the beginning of the program that biden implemented in 2023 january 2023 404 000 the number now is about is over half a million inadmissible aliens have been paroled into the country through this chnv program this is the program that trump just scrapped

[00:29:59] and told everybody if you got paroled inside the country under this program you got a month to get out and now a judge has said you can't do that you have to give them individual appearances like court appearances you gotta you gotta take every one of these cases individually this is you've heard this term before i'm sure cloward piven it's a cloward piven strategy cloward and piven

[00:30:29] i believe they were married these two researchers sociologists leftists i think they were out of nyu or something and cloward piven strategy refers to what they laid out in one of their books was to overwhelm the government systems in order to achieve a different goal their goal was to frighten the middle class

[00:30:58] and the wealthy into agreeing to do a basic guaranteed income for everybody and so they were going to overwhelm the you know medicaid rolls food stamps like all of the government benefits and services overload all of these systems with people and then the the problem becomes so great and it starts to collapse the institutions because they're you know marxists and that's what marxism does that's the whole point

[00:31:28] like what do you think decolonization meant what do you think uh... the revolution refers to it is the tearing down of the institutions it is a cancer from within and people have ignored this for decades they thought oh so the union fell no more commies no no i refer to watermelons watermelons are the greenies green on the outside but red on the inside

[00:31:57] the watermelons i know people use that emoji for something else nowadays i forget what the is that for the palestinians also kind of marxist um this is the philosophy in my opinion it is an evil philosophy it is rooted in envy i'm going to take from that person because i want what they have and i'll redistribute some of it around i'll be the one in charge

[00:32:27] right it's power grabbing and so half a million of these people came in under this program which was unlawful and the homeland security under the previous administration admitted that these people were not allowed to be in america because they came from these countries that they weren't allowed to be from over half of all of the monthly encounters at ports of entry this fiscal year according to the report from the

[00:32:57] house oversight committee were from cuba haiti nicaragua and venezuela it's amazing when you offer free flights to america how many people in the targeted countries take you up on that offer as highlighted in a previous report an interim report on the border crisis this is by the committee in 2023 the biden administration created the chnv parole program to grant travel authorizations for qualifying

[00:33:27] inadmissible aliens i love that so they're inadmissible but they qualified just making up terms qualified inadmissible aliens to fly into the country and be released under a two-year work authorization that's what was granted to them a two-year work authorization dhs expanded the use of its cbp1 app the customs and border protection app for the phone

[00:33:55] they expanded it from the intended commercial use to allow illegal immigrants who participate in the chnv parole program to then schedule appointments through the app in march of last year a haitian national who entered the country through the chnv program was arrested for aggravated rape of a 15-year-old girl in rockland massachusetts in february 2024 secretary mayorkas was impeached

[00:34:25] for high crimes and misdemeanors due to his refusal to comply with the laws passed by congress and his breach of the public trust mayorkas defied the immigration and nationality act by abusing the permissibility for parole which he was allowed to grant on a case-by-case temporary basis only for significant public benefit
