I'm Tony Marino holding down the fort for the vacationing Pete Calender. Long time LA attorney to the stars and legal analyst, Royal Oaks is with us. Merry Christmas to you, my friend. Happy New Year. So good to speak with you again and we have a lot of ground to cover. Hey back, Ashya, always good to talk to you. Is your daughter still over there at Duke or did she graduate early? She did graduate, and she chose pathology as her specialty, and so she is doing stuff that I have no understanding of. But fortunately, you know, kids get smarter than the previous generation. So that's great, that's what that's what we hope for, right Exactly. Some kids we have to say, all right, so there's there's a bunch of things I want to cover here. And before we get into it, let me tell let me ask you one other thing or tell you one other thing. I know you're in LA or the LA area, right. I'm not a real big California person, as we've probably discussed before, but I was recently out in Palm Desert, Rancho Mirage. If you have any contacts out there, hook me up, because that's the next place I need to live. Oh, you know, Palm Desert is beautiful, of course, Palm Springs. It's about a two hour drive east of Los Angeles and in the surrounding community, you know, the Cathedral City, Latinta, Palm Desert, Indio. It's just a beautiful area. It's a little toasty, of course in the summertime, but yeah, it's a fantastic place to vacation. And of course Frank Sinatra hung out there and Betty Ford and Jerry Ford and it's my wife. Actually was struck by a golf ball hit by Gerald Ford. He used to regularly play at the Yeah, at the golf tournament's out there, the Bob Hope Classic, And it was funny. The ball barely rolled up and hit her on the ankle. The Secret Service came up and they acted like she was some kind of terrorist, like, now, who are you? And I was. Mentioning to them, you know, the ball hit her. We're standing in the crowd. But you know, you can't be too careful. Like it, right, And did you mention you were an attorney? No? No, that didn't come off. Yeah. I didn't want to be hauled off, you know, and interrogated myself. All right. So one of the one of the biggest stories out there, obviously, and one of the biggest stories in the country royal is the murder of Rob Reiner and his wife by their son Nick. I've now been hearing talk about, you know, was it premeditated murder or did he just snap or you know, something set them off at the party they were at at Conan's. Was it an impulsive killing? I mean, so, what's what are the things going to happen here? Well, the latest news is that there are unconfirmed reports that he was taking a drug for schizophrenia. Now, if that's true, of course, it's a tragic condition where people just don't have a connection with reality. And you have to say that if the DA's allegations that we've got our man are true, namely that Nick Reiner actually committed the killings. Then of course the scene shifts immediately to his metal state. He's got this celebrity lawyer, Alan Jackson, who's you know, represented Harvey Weinstein and Kevin Spacey recently. And what Jackson did in court recently a few days ago is very interesting. He said, judge, I'd like to put off the arraignment a couple of weeks. And the arraignment is just you know, you read the charges and the guy says not guilty. There's really nothing much to it. So the fact that he wanted time means, of course he's digging very deeply into the issue of Nick Reiner's metal state. One possibility is he was insane. The definition of that is he didn't know right from wrong. If that's true, he's not guilty, but he is confined to a metal hospital maintained by the state. The other option is they want him for murder or the death penalty, which is rarely used in California, but it's still in the books. But the response by Alan Jackson could be murder, I don't think so. That requires somebody who pretty much is of sound mind. If a person through voluntary intoxication of drugs or alcohol or mental illness just really isn't all there, but not so far as insanity. You can't be found not guilty in that condition, but you can be found guilty of manslaughter, which it could be three years, six years, nine years in California, as opposed to murder one which is twenty five years to life, or even the death penalty. Since he killed allegedly two people, that sets him up for the special circumstances warranting capital punishment. It would be drastic, but you're saying, taking all of that into consideration, there's a possibility where he would get four or five years maybe exactly. So. Murder in the first degree is where you intend to kill and you have the legal mental capacity to form that intent. If you intend to kill somebody, but you are so overcome by alcohol, drugs, mental illness that you didn't really have, you weren't really a sound mind. Although you were saying you knew right from wrong. That can kick it down in the minds of a jury. To manslaughter and voluntary manslaughter, as I was saying, you could easily get ten years or less. Now you have two victims, so you might double the number. But we're talking maybe ten to twenty years. And it's interesting. I mean, the family members, of course, are horrified and furious at the death of their parents or family members in the extended family, and yet you can bet they are behind the idea of this high powered lawyer paying him the big bucks. It's very different. Oh yeah, in this case where them and the men is menenda situation. The extended family probably hated Kitty and Jose thinking they were monsters too. Nobody's claiming Michelle and Rob were monsters. But I think the family's attitude is, look, he needs help, he needs treatment. He doesn't need to rot in a cell for the rest of his life. Maybe he deserves to go to prison for X years, but let's make sure it's not for life. Let's make sure he gets the help. I think that's why you're seeing them circling the wagons and hiring the fancy lawyer to defend Nick Ryanan. Yeah, and you know, obviously this is just a very very beginning of a long road ahead. And if he does end up getting of a lenient scent, a lenient sentence, it would be you would think times too all right, Now, let me move on to one of the cases that WBT listeners really care about, James Komy. The DOJ now trying to find another way to charge Komy with something after the the original charges were dismissed. What do you think is going to happen with the former FBI director? If anything, Well, you know, the Trump administration might have an uphill battle because the dismissal of the charges. The trial court judge now goes up to the fourth Circuit Court of Appeals. Now who knows what might happen, and whoever loses at that stage, of course, can go to the US Supreme Court. A lot of people who don't like Trump cynically say, well, you know they've brought and paid for He appointed three of them. You've got a conservative majority of either five four or six three. But we've seen over the last year or two a lot of decisions go against Trump out of that Supreme Court. So you no guarantee that he is ultimately going to win. We just really don't know whether what the chances are of Komi being of the indictment being revived. There's another sort of wild card also, namely what about the statute of limitations. I mean, the charges against him are related stuff that happened about five years ago, and so the Trump administration barely beat the status. Sometimes the statute gets put on hold when when you have appellate matters like this, when when a prosecutor is challenged. But the bottom line is it's very much in the air. James call me sounds confident when you see his social media posts, but he knows as an experienced lawyer that anything can happen, and he's not really out of the woods yet. Well, anything could happen. But like you said, when they when they dismissed the first charges, chargers that that pretty much came with the statue of limitations expiring as well. So I'm assuming it would all depend on what kind of charge they they they bring next. Right, It's going to depend obviously what they charge him with, and and that would dictate what chance there is of him, you know, being indicted on anything. But yeah, that's exactly right. Every single yeah, every charge has a different statute of limitations. In this case, probably the Trump administration pretty much came up with the charge that they felt was the strongest and possibly the only possible charge, which, as you know, is him testifying years ago allegedly lying to Congress when they asked him, well, did you authorize leaks over this Russia collusion thing? And he said no, I didn't do anything like that. Well, apparently the DJ feels that they've got the goods on him and can prove that he did lie. And of course it comes with the usual combo of politics and law, because the Trump's critics say, well, he's just trying to have a chilling effect on people, you know, his enemies. Leticia James, James Comy. If you annoyed Donald Trump, you're going to have the DJ cunning after you. On the other hand, if the DJ doesn't have the goods, if they don't have the evidence, then a judge is really just toss it out or the appellate court can toss it out. So yeah, it's all very much in their up in the air for James Comy. Yeah, James Comy, John Bolton, you mentioned, Leticia James, everyone. That they John Brennan, the CI. He's all right, Josas on Brennan, the bidens, I mean, they haven't been successful unfortunately in anything as of yet. And real quick because when we get into the new year, this is going to be one of the potentially very major major decision from the Supreme Court on Trump's tariffs out. It's really hard to see them saying that the tariffs are not illegal and we somehow have to give all that money back. But what do you see there? I think you put your finger on the essence of it. Based on reading the tea leaves and hearing the questions from the Supreme Court justices from weeks ago when they had oral argument in November, it sounds like the Court is going to say, nice trime, mister Trump, but this really wasn't an economic emergency. You can't take away from Congress traditionally and historically has the power to impose tariffs. But if they do that, I don't think the Supreme Court is going to say, oh, and by the way, anybody can step forward and get refunds. That would just be a a snarled, gigantic international mess. My guess is that they're going to say, now, you couldn't do this, mister Trump, but we're not going to make it retroactive, so nobody can get the get the refunds. So that's just my horseback guess as to what would likely to see, but we'll probably see it very soon because I think the court knows inquiring minds want to know. Namely everybody around the world who was affected by r will probably get the decision in the next couple of months. Right, this is not just a United States thing. This is, you know, effectively affecting the entire world or could affect you know, a big portion of the world. Plus you know, there's a lot of Americans that want that tariff bonus check that they've been talking about, the two thousand bucks exactly you're supposed to send to people. So all right, so this is why I love having you on because I didn't realize that was even a possibility. So they could say, no, you don't, you didn't have the power to do that, but at the same time say, well, you're not. You're not going to give the money back obviously, so there's really no punishment. It was wrong, but there's really no punishment. Right. Courts have the power to say that their orders are retroactive or only prospective. It's completely up to them, and they know they don't want to create a huge, snarling mess that crosses every border around the globe. All right, and real quick. I was just kind of putting you on the spot here, but in twenty seconds, what's your honest take on Pambondy is she? I have friends now that call her Pam Bundy, like she's you know, bungling things. You know, what's your take on the attorney General? You know, I think she's got such a tough job. And you remember what happened with the Sessions the attorney general under Trump in the first term. They just really falling out. I have a feeling that she'll survive the bad publicity. It's just she's in she's under a microscope. But I think she's going to hang in there at the end. All right. That is Lay Legal Analysts, one of the best. Royal Oaks Royal always great to have you. Happy holidays to you and your family and I'll speak with you soon. Same to you. Thanks a lot, all right. Robert is up next? Good afternoon, Robert? What's up? Good afternoon, Tony. You're doing a heck of a job. Filling in for Pete. You know, Pete is a giver, but he does take quite a bit of vacation, so big shoes to fill. But I think you're doing it well, sir. Well, thank you very much. I appreciate that. And it's good to know he takes a lot of vacation, because I'll ask to fill in more often than well. He does a lot of work too, though, So that's a good that's a good mix. Regarding the shipbuilding that you're talking about, the humbly named Trump class, the new battleships, the big ones, the hottest one, the hottest ones in the world, the most lethal ones in the world by far, I saw a. He does have a way with words, doesn't he. Yes, yes, he's He doesn't mind touting his achievements. I guess you could say, by the way, I'm a three time Trump voter, but I like to make fun of him a little bit every once in a while, just really based on his style more than his results. I think his results have been very good for the most part. But I saw Carlos him Inez, a Floridian congressman, yesterday saying that the Chinese are building are building warships at a ratio of two hundred and fifty to one for hours and that, and he said it. More than once. I find that ratio hard to believe. Yeah, I honestly do not know that number. I know that China is building a lot more warships than we are. They're building more fighter jets than we are, They're building more of everything than we are. I honestly wouldn't know what the ratio is. But that does sound that does sound like a lot. But that's also part of the reason that the president, you know, came out with this push. And if you're you're a three time Trump voter, you know that he's been I mean, he's he was talking about this way back at the very beginning of this campaign, you know, like what eighteen months ago, fourteen months ago, Tony. I don't know if you can hear me, but I can barely hear you. I'm I I think I've got a bad signal here. But anyway, Yes, I do believe, if you're still there, I believe the President has done a good job. Yeah, I hear you. I hear you loud and clear. I'm not sure why you don't hear me, but I hear you. Loud and clear, and I was saying this, this is this is something you know that the president has been passionate about for some time. This is something he's talked about since the very beginning of this campaign for the twenty twenty five presidency. Yes, and of course he one of his achievements in his first term, I think it's fair to say, was that he he did rebuild our military to a pretty pretty big expense. Just one another quick point, if we have time, Yeah, go ahead on Pam Bondy. I heard you mentioned Pam Bondy. I think Pam Bondy and you all mentioned Jeff Sessions who had a falling out with the president President forty five Trump, and of course also Attorney General Bill Barr had had an eventual falling out with the president as well. I think I think Pam Bondy is in a crucible right now. I think she is under unbelievable pressure to to get out those Epstein results and yet not not a. D her boss. Yeah, I mean she she probably has one of the jobs in the world right now that you would not want to have, regardless of how much it paid. And she probably made a lot more when she was an attorney in the private sector. I've followed I have followed Pam Bondy sort of, you know, for a long time. I live in Florida. I've worked in the news business in Florida for a long time. She was the attorney general here for a long time, so you know, she's she was in the news a lot, She scored a lot of victories, She did a lot of good in the state of Florida, and I was I was completely fine with her as the pick when when Trump picked her to be the attorney general. At the time, I would have said, I anticipate her doing a very good job. And I'm not going to say she's not doing a good job, but there's definitely some questions. And that I mean the Epstein files, the Epstein case, whatever you want to call it. That is the biggest issue that I think most people have had with her. And when she came out and said the file is on my desk right now, you know, and then it wasn't on her desk, and then it didn't exist. I mean, you don't know how much of that she's getting from other people, right. Yes, By the way, I could only hear about half of what you said but yes, yes, the saying was on my desk. That was a misstep. I hope she. I hope she releases all that information. Let the chips fall. There could be up to twelve hundred victims, and so far I think only four or five people have paid to any extent, So whether no matter who likes it, I hope she'll release those files basically in their entirety. Yeah, you, you, me and a lot of other people in the country. Robert, thank you very much for the call. Great speaking with you. Merry Christmas, Happy holidays. Thank you for listening to Pete on a regular basis. I'm sure he appreciates that. I'm Tony Marino in for Pete Calener. Dan Bongino, I think is stepping down for several reasons, and one of those I think is that he has been butting heads with Pam Bondy, and I think when he gets back on his podcast or the radio, if and when that happens, you know, little by little we may hear more about it. But again, Dan Bongino also lived in Florida for a long time, had a relationship with Pam Bondi for a long time. Certainly familiar, you know, with her work and things that she had done. So it was odd that they seem to be butting heads. But you know, we'll see what happens outside if you put the Epstein fiasco, let's call it aside. Put the Epstein case aside, and what has happened and what hasn't happened for the most part, For the most part, you know, I think she's done a pretty good job because she is in a very difficult position. Visit creativideo dot com. Brandon mentioned in the news there another homicide in the Queen City. You know, and when you work in the news business, after a while it just becomes another news story. But then you stop and you think, regardless of the circumstances, this is a life, right, It's someone's son, somebody's daughter, brother, sister, mother, father. Police conducting a homicide investigation in the University area Charlotte, Mecklenberg Police say officers arrived on the scene to find a man unresponsive just beyond the parking lot in the fifteen hundred block of Farm Lane. He was declared dead at the scene. They did not say what the cause of death was. As Brandon mentioned, now you know they arrive on the scene to find a man unresponsive. Could be a medical emergency, right, that would be maybe your first instinct could have been a medical emergency. We don't know how old the ban is, but since he was found in the parking lot, if I had to guess, you know, I would guess it's another result of some kind of violence. The apartment complex right off East W. T. Harris Boulevard, and anyone the police, of course, or asking anyone with any information about the victim to call Charlotte Crime Stoppers. So if you live in that apartment complex, maybe you saw something. If you live in that area, maybe you've seen something or maybe you just know something because you know people. Anyway, Unfortunately, there you go, another homicide in the Queen City. And as I mentioned, it's you know, almost every day, if not every day. Yesterday on this show, I spoke with former RNC chair and North Carolina Senate candidate Michael Wattley. Hopefully you were here for that interview. Spent a decent amount of time with him, got into a few things. If you were not here yesterday didn't hear that interview, you can check it out WBT dot com. Just go to the podcasts WBT dot com. Go to the Pete Callander Show podcast and it'll say Tony Marino filling in for Pete with former RNC chair and North Carolina Senate date candidate Michael Wattley. Today, turns out Michael Wattley has another challenger for that GOP seat here in North Carolina. Michelle Morrow, previously ran unsuccessfully for the state superintendent. Very involved, or at least has a lot to say about public schooling in the state of North Carolina. She also told Queen City News that right now, right now, which would include Michael Wattley, right now, she's the only person in the race that can beat former Governor Roy Cooper. She's one of several Republicans challenging Wattley. But as I mentioned yesterday and as I mentioned earlier, he has the full full endorsement of President Trump. He explained yesterday how he really didn't have aspirations, or I shouldn't say really didn't he didn't have aspirations of running. You may recall when Senator Tom Tillis announced his resignation, there was talk of Laura Trump running for that seat. And when Laura Trump decided she was going to go work over at Fox, not that she needs the money, but go work over at Fox and probably make a whole lot of money, or do what she really enjoys doing. Rather than get into politics, at least at this point. Right, That's when the President reached out to Michael Wattley and sort of convinced him to run. And we spoke a lot about former Governor Cooper, and you know what Michael Wattley believes in and wants to do compared to what Roy Cooper would do the presumed Democrat nominee. But we really didn't talk about challengers on the Republican side. But if you were not aware of the fact there are challengers, it's now Michelle Morrow, and I forget who the other person is, but there's a couple of people that are seeking that seat. And of course, you know Michael Wattley with the President's endorsement and the big event over in Rocky Mount on Friday night, which was only one of a couple of events that they've had. And I'm sure, I'm sure President Trump will be coming back to the tar Hill State in twenty twenty six promoting Michael Wattley or rallying for Michael Wattley as we get closer to the midterm elections. But that is interesting, for sure. And did you catch the Kennedy Center Awards last night filmed in Washington a couple of weeks ago. You may have heard or seen at the time. You remember President Trump handing out the awards to Kiss and Sylvester Stallone and Michael Crawford inside the Oval Office, which the in the you know, typical Trump fashion, had never been done before. Right. They always have this you know, big awards ceremony where they bestow these these Kennedy Center honors on to people from various walks of life, mostly entertainment, but it was the first time that they were handed out in the Oval Office. All right, if you're listening to this show, you know I try to keep up with all sorts of current events, and I know you do too, And you've probably heard me say get your news from multiple sources. We are in the home stretch, and I'm going to say this right now at the open of the segment in case I forget to say it at the end of the segment, but I wish you and your family the very merriest of Christmases a happy, healthy, and prosperous New Year as well. I don't know, let me throw this in there. As far as traveling, Pam continues to tell us that things are moving along surprisingly well. For the day before Christmas Eve on Charlotte area roadways, one hundred and twenty two million people are expected to travel at least fifty miles from their home on Christmas. Two point seven million people are expected through Charlotte Douglas Airport within the next couple days. Two point seven million people. If you are traveling via air, if you're making your way to the airport today, tonight, tomorrow, or you know, coming back on the weekend. The thing about Thanksgiving and Christmas is the travel kind of ramps up as you get you know, because now so many people not in radio, but so many people get so much time off of work. Now it's not just a one day thing anymore. I mean years ago, everybody worked like right up till Thanksgiving. You were off on Thanksgiving Day, maybe some people were off the day after. That was it Now? People like in Florida, for example, where I live, government workers get off the day before Thanksgiving, Thanksgiving and the day after Thanksgiving. So people say, heck, why not go for the whole week? Right, So the travel starts on the weekend and then Monday, Tuesday, Wednesday, same thing this week, but then coming back like Sunday, everybody he'll be trying to get back on Sunday. Two point seven million people through Charlotte Douglas Airport. So if you are traveling. Best of luck to you, give yourself, you know, extra time of course, all that you know, all all the stuff that you know. But again, have a fantastic and so one seventy nine, let's go back to the phones with Joanna. Hi, Joanna, Hello, Hello, can you. Hear me. Barely? Get me one? Thank you? Here? Yeah? Turn up the volume all right, I hear you now you hear me? Good? Yes, I can hear you. Fine? What what's up? Well? I get it, got on my got in the car and started listening to one O seven nine. Too, and merry Christmas, and y'all stay safe. Okay, yes, thank you, dear you too. Seven four five seven oh one oh seven nine. Here's something to look forward to. All right, so we talked with James Rosen, you know, about the year that was the first year of Trump's second presidency, some of the differences between his first term and this term, and you know, some of the truly truly never before kind of seen and done things in Washington, in the White House, in the press briefings and all that with the Trump administration. And then we spoke with doctor Jessica Duncan about looking forward to twenty twenty six and getting ready for your diet, your exercise, you know, how to make some small changes and get healthy, which is the most common New year resolution. Right as people get ready to start making their New Year's resolution, one other thing to look forward to coming up in twenty twenty six. This is according to analysis from the Financial firm Piper Sandler a much bigger tax refund. Piper Sandler projects that the average refund is going to climb to more than three thousand dollars for twenty twenty five or the twenty twenty five filing season. All right, that'll do it for this episode. Thank you so much for listening.
