Fani splitting decision in Atlanta and Hunter runs from appearance (03-15-2024--Hour1)

This episode is presented by Carolina Readiness Supply A Fulton County judge says Atlanta District Attorney Fani Willis can either fire her former lover from the Trump election interference case or she can step aside herself, in a classic "splitting the baby" type of ruling. Plus, Hunter Biden's lawyer says the President's son will not show up to a congressional hearing next week - despite previously demanding a public appearance before the committee.

[00:00:38] I am aware that apparently the stream of the show yesterday was down and apparently yesterday's

[00:00:47] podcasts have not been loaded up. They're not they're not populating into the into the podcast

[00:00:55] feed. So if you guys could Tommy John, you guys, oh, I just want to throw me under the

[00:01:02] bus for this. You guys could just check into it for me. I'll look into it. Just look

[00:01:06] into why there was no podcast. I'll answer. I just realized Tommy John. Did you guys

[00:01:15] realize? No, we did it. Look at us go. Yeah, you're like the like a Hall of Famer baseball

[00:01:20] pitcher. Let's go do some surgery. Yeah, and surgeries. That's right. No, there was

[00:01:25] no program yesterday. We did not do a show yesterday because we had the UNC Tar Heels

[00:01:31] playing on the WBT airwaves. And as such, we had no program and believe there's some

[00:01:38] sort of contractual prohibition against us feeding that down I guess on the live stream.

[00:01:46] I guess I don't know. That's why there was no live stream feed of the on air signal

[00:01:52] where you would even know it just was popping up as like, Hey, there's no feed and people

[00:01:56] were messaging me. Hey, there's no feed. And I think it has licensing rights has to

[00:02:01] do with the licensing rights or something like that. I do not like that to me. Like

[00:02:07] that's below the line for me. I don't need to know that kind of it's actually above

[00:02:11] the line. It's way it's above my pay grade. I don't I don't know all of the ins and outs

[00:02:16] of it, but that's the way that happened. And so no, there was no show so no, there's

[00:02:19] no podcast. So all that means is we're going to have to jam two days worth of content

[00:02:27] into this one day. All right. So here we go. Fanny. Fanny. So the judge, I know there's

[00:02:38] a joke here someplace. I'm trying to think of it about, you know, split in the baby,

[00:02:44] split in the Fanny, but it just I can't I can't make it happen. Winter bull said split

[00:02:50] the baby in half in his conversation. Right. That's the right. And so they're that's

[00:02:53] what they're saying split the baby. It's a common thing in the legal field like when

[00:02:59] the judge is trying to, you know, with Solomon, right, split the baby and no, no, no, don't

[00:03:04] kill the baby. And that's the real mother. Anyway, um, Fulton County District Attorney Fanny

[00:03:10] Willis is going to be allowed to continue prosecuting the Georgia election fraud case against

[00:03:15] former president Donald Trump. And more than a dozen other co-defendants, if, if she

[00:03:22] cuts ties with the special prosecutor, a K a her former lover whom she hired to lead

[00:03:32] it. This is according to the superior court judge in Fulton County, uh, Scott McAfee.

[00:03:39] Uh, love his, uh, protection software. Anyway, in order to cure an appearance of impropriety,

[00:03:48] so it's the appearance. I mean, I'm not saying this is impropriety in and of itself. I'm

[00:03:53] just saying it's got the look of it, you know, it just it appears improper. So McAfee

[00:03:59] told Fanny you got two options, either Wade withdraws or you and your whole office steps

[00:04:12] aside. So either Wade runs the show himself or your office, you and your office run the

[00:04:19] show. Now I would be really surprised if this woman bows out of the spotlight. So, I mean,

[00:04:31] she's not even stupin the guy anymore. So why even you're not even getting any of the

[00:04:34] trips, you know, more cruises for Fanny. So um, the rule is a blow to the defense who had

[00:04:41] called for both Willis and Wade to be dismissed from the case in the 23 page ruling McAfee found

[00:04:48] that defense lawyers failed to meet their burden of proving that Willis acquired an actual conflict

[00:04:55] of interest in the case through her relationship and her travels with Nathan Wade. However,

[00:05:02] the judge wrote, however, the established record now highlights a significant appearance

[00:05:10] of impropriety is just a lot of smoke, a lot of impropriety smoke all around and really make

[00:05:17] out if there's a fire. He says it infects the current structure of the prosecution team. McAfee wrote

[00:05:25] that quote, an odor of mandacity remains. So we got odors. We got smoke. No fire and no poo, I guess.

[00:05:37] At one point in his ruling, he even shited Fanny for quote, making bad choices and for a quote,

[00:05:47] tremendous lapse in judgment. And quote, unprofessional manner of her testimony, the unprofessional

[00:05:56] manner of her testimony, which we carried. Remember, we played the audio of the of that testimony.

[00:06:03] I've not seen a more condescending arrogant obnoxious witness ever on the stand than Fanny Willis.

[00:06:13] He also wrote that Wade threw his inaccurate filings in his pending divorce, quote,

[00:06:20] indicates a willingness on his part to wrongly conceal his relationship with the district attorney.

[00:06:26] Oh, no really. So I guess as a lawyer in Fulton County, you can in fact file incorrect

[00:06:39] filings with the court inaccurate filings with the court. You can do that in Atlanta.

[00:06:44] I'm sure this is going to be news to a lot of the lawyers in Atlanta who are now going to be

[00:06:50] able to just submit all sorts of filings that are inaccurate. I mean, it really cares. Right? That's

[00:06:55] just not my standard defense lawyers also said it was disqualifying for Willis to give a mid-genuary

[00:07:05] speech at Atlanta's big Bethel AME church during which she accused the defense attorneys of

[00:07:13] quote, playing the race card because both she and Nathan Wade are black. Defense lawyers argued

[00:07:22] that the obvious intent of that speech was to inject and infect the Fulton County jury pool.

[00:07:29] I'm, I guess, inject race and infect the jury pool. Right? Which, you know, by the way,

[00:07:37] I got to believe that your appeal, if you lose, is going to cite heavily the speech at the church.

[00:07:47] Right? Her sermon, Fanny Sermon.

[00:07:51] Maccafe the judge held three days of hearings over the motion last month. Both Willis and Wade

[00:07:56] testified that although they know they that they had known each other but not in the biblical sense.

[00:08:01] They had known each other since late 2019. Their romance did not begin until early 2022.

[00:08:08] After Willis had already hired Wade to serve as special prosecutor.

[00:08:13] Defense lawyers accused them of lying about that on the stand and in court filings contending

[00:08:20] that the relationship likely started years earlier. And by the way, this was based on the

[00:08:25] information of two friends of Fanny and Nathan. Right? Willis and Wade had two people close to

[00:08:36] them both of whom said that the relationship had begun years prior and the judge apparently just

[00:08:42] chose to ignore their testimony. Well, one of their testimony because the other one was the

[00:08:49] former law partner and lawyer for Nathan Wade who then when he got on the stand remember he

[00:08:53] could not recall anything that he ever said ever related to anything regarding Willis or Wade. He just

[00:09:03] it's the most forgetful lawyer I have ever seen like I would not use his services because he

[00:09:09] apparently although actually he might be the perfect lawyer because you know like the guy

[00:09:15] the guy will get up there on the stand and I he'll take bullets for you. It looks like that.

[00:09:21] That's what it that's what it looked like to me. The judge wrote that the cash reimbursement practice

[00:09:29] with her stash of cash it may be unusually said in the lack of any documentary corroboration

[00:09:35] understandably raises concern but he concluded it was not so incredible as to be inherently

[00:09:43] unbelievable. Not so incredible as to be inherently unbelievable really. So the judge is like

[00:09:53] yeah, I mean, I guess I could believe that okay. Hey, Judge, I have a bridge

[00:09:59] that I would like to sell you. All right well just as I predicted Drift King sports book is now

[00:11:16] Twitter it is at Pete calendar that's KAL I N E R a message here from Andy who says so apparently

[00:11:26] the judge in Atlanta did not spank fanny.

[00:11:33] goes the dynamite um

[00:11:39] all right I always got to read Dan's first make sure it's suitable for air.

[00:11:45] Pete is the odor of mendacity the same thing as this place smells like fanny

[00:11:52] tana I think maybe um back to this piece by the way this is from Ryan Mills I believe yeah

[00:12:00] Ryan Mills at national review um that the going over this judges ruling macrophy is the judge in the

[00:12:09] in the you know the the attempt to get Willis and Nathan Wade tossed off the case

[00:12:16] um the judge wrote that neither willis's payments to Nathan Wade to lead the prosecution

[00:12:22] nor their romantic relationship is problematic on its own but in combination it's sort of like

[00:12:29] uh you know chocolate and peanut butter two great taste of taste great together you know it's

[00:12:33] like you put these two things together and now it is a quote prima facie argument or facie

[00:12:40] uh facie on its face uh argument arises of financial enrichment and improper motivations which

[00:12:49] inevitably and unsurprisingly invites emotions such as this however the judge found there was no

[00:12:55] evidence that Wade was overpaid for serving as special prosecutor that he exceeded monthly caps

[00:13:04] on his hours or that Willis and Wade tried to prolong the case in order to enrich themselves

[00:13:09] there was no evidence of that and uh also of note last week this same judge struck down six counts

[00:13:20] in the indictment against Trump and several other of his co-defendants in the case those counts

[00:13:25] involved the alleged solicitation of Georgia election officials to violate their oaths of

[00:13:31] office and to unlawfully appoint pro-Trump presidential electors saying uh that they lacked sufficient

[00:13:39] detail um and that uh they did not give the defendants enough information to prepare their

[00:13:46] defenses intelligently that was what the judge had ruled uh last week in eliminating a bunch of

[00:13:52] the charges okay so there is the update on fanny and Wade next up hunter Biden president

[00:14:02] Biden's son not gonna testify publicly before the House Oversight and Accountability Committee

[00:14:10] this was scheduled for next week as lawyer told the GOP chairman in a letter this week that

[00:14:15] hunter Biden is uh going to uh he's gonna treat the committee basically uh the same way that he

[00:14:23] treated uh that illegitimate daughter of his I'm just kidding no he's just gonna wait now he's not

[00:14:28] gonna show up that's what that's all I meant he's not gonna be there he's not gonna show up he's gonna

[00:14:33] okay um representative James Comer of Kentucky uh head of the Oversight Committee Republican

[00:14:40] announced last week that he had invited hunter Biden and several former business associates

[00:14:45] to answer questions at the hearing set for March 20th but Abby Lowell hunter Biden's lawyer told James

[00:14:52] Comer that neither he nor the president son can attend because in part because they've got a court

[00:15:00] hearing in California so they're gonna be tied up in another court proceeding so they don't really

[00:15:05] won't be able to come to your thing but that's just one of the reasons they have another reason

[00:15:10] they have another reason they and they have a demand all right do the current world events have you

[00:15:16] wondering whether we are teetering on the edge of catastrophe are you concerned it's gonna reach our

[00:15:21] shores okay so what are you doing about your concerns let me help Carolina readiness supply at

[00:15:28] Carolina readiness dot com whether you're looking to expand your emergency preparedness supplies

[00:15:33] or you have no idea where to even begin Carolina readiness supply can help you food water purifiers tools

[00:15:39] first aid kits instructional materials camping and hiking supplies even because being prepared

[00:15:45] is just smart Carolina readiness supply has two thousand square feet of supplies and educational

[00:15:50] materials that you'll need for any kind of emergency in wainsville and always at Carolina readiness dot

[00:15:56] com veteran owned Carolina readiness supply will you be ready when the lights go out so hunter Biden

[00:16:03] through his lawyer Abby Lowell says he will not appear in front of the house oversight and accountability

[00:16:11] committee manly because he's got another court hearing out in California but there's another reason

[00:16:16] he's got another reason and and a demand quote the scheduling conflict is the least of the issues

[00:16:27] this is according to the attorney in a letter to the chairman of the house oversight and

[00:16:33] accountability committee says your blatant planned for media event is not a proper proceeding but

[00:16:39] an obvious attempt to throw a hell marry pass after the game has ended so you know me I don't

[00:16:51] over the metaphors some okay actually I do yeah I do okay how can you be throwing a hell marry pass

[00:16:58] after the game is ended is it like you snap the ball before the clock runs out and then the clock

[00:17:04] runs out while you're scrambling around to throw the hell marry pass because then I would think

[00:17:08] you would say you're throwing the hell marry pass after time expire not after the game ended

[00:17:14] because if the game ends then the game's over right you can't be throwing the pass unless of course

[00:17:18] you snapped it which means the play okay never mind I'm in the weeds here anyway he called the

[00:17:23] scheduled hearing a carnival side show just a fully mixed the metaphor um and he says hunter Biden

[00:17:30] would consider an invitation to a hearing with here's the demand relatives of former president Donald

[00:17:36] Trump who have engaged in their own work overseas after Trump left office so there are the uh

[00:17:45] goalposts getting moved right there for you just to bring it back to the bring it back to the sports

[00:17:50] analogy right so now he says he's not interested in showing it remember hunter Biden appeared

[00:17:59] in front of the committee when they were getting ready to start up some of the proceedings and he

[00:18:06] shows up and he sits down in the gallery and the lawyers like oh he's totally here to testify

[00:18:12] you know he's he's he wants to be on the record in front of the public and tell his story and blah blah

[00:18:20] block and then he gets up and walks out remember that of course that was the second stunt he pulled

[00:18:26] because the first stunt was when they were they uh uh sent in the subpoena to him and wanted

[00:18:34] to depose him and he shows up at the Capitol and does a press conference from the steps of the Capitol

[00:18:41] and he says he's not going to go to the closed door deposition because he's demanding it be in open

[00:18:49] he wants it out in the open he wants to appear publicly before the committee so they can't

[00:18:55] leak stuff that he says in a deposition he wants everybody to hear it in his own words

[00:19:02] and then he agrees to the deposition but after he pulls the stunt where he shows up at the hearing

[00:19:10] for somebody else he shows up there was a Tony Bob a linsky you know who was it

[00:19:16] those the IRS guys I forget but somebody else was appearing before the the committee and he shows

[00:19:22] up with his lawyers and they sit in the front row and then they get up and storm out when marjorie

[00:19:27] Taylor green starts like showing the nudes from the laptop or something so he calls the scheduled

[00:19:34] hearing a side show carnival side show calmer says quote hunter Biden for months has stated he wanted

[00:19:43] a public hearing this is from the cbs news he says um or this Melissa Quinn at cbs news

[00:19:55] says hunter Biden testified behind closed doors before members of two house panels in a deposition

[00:20:00] last month the seven hour session uh where Biden reiterated that his father was not involved in his

[00:20:08] foreign business dealings hunter Biden initially defied a subpoena for his closed door

[00:20:13] testimony and insisted on answering questions in a public hearing setting

[00:20:17] jail be lawmakers have spent more than a year investigating the president and his sons foreign

[00:20:24] but have not uncovered evidence of wrongdoing by the elder Biden this this is so much this is so

[00:20:31] like the Hillary Clinton emails server thing you know where they're like oh butter emails butter emails

[00:20:38] and I always say the smoking gun is not the emails because she deleted them all the smoking gun

[00:20:43] is the server she set up a server so she could delete permanently any record she wanted

[00:20:53] any email she wanted which is precisely what she did and she wants us to believe that 30,000

[00:20:59] emails were only about her yoga schedule and her daughter's wedding seating chart right garbage

[00:21:09] garbage excuse complete bs and you can't prove anything because she wiped it like with a cloth

[00:21:17] yeah she and bleach bit and hammers to the cell phones and all of that right

[00:21:24] so this idea that oh there's no evidence of wrongdoing by the elder Joe Biden

[00:21:29] the whole point is the relationship right you keep they keep demanding there to be like some sort

[00:21:38] of a big check written like two Joe Biden you know from China memo line for bribery you know

[00:21:48] you're not going to find that that's not how these things happen this is this is an influence

[00:21:54] pedaling operation they're selling access but also more importantly whether or not they can

[00:21:59] provide the access or not they're being compromised that's the problem they're being compromised

[00:22:06] through a family member and this stuff happens all the time hello look at James O'Keefe

[00:22:13] like that guy with a tinder account and a pair of glasses like he's hookin up with all of these

[00:22:20] government employees uh that that go out on dates with the guy their gay men that he like he catfishes

[00:22:27] and he gets them and if I said this on twitter the other day if James O'Keefe is this successful

[00:22:33] catfishing these dudes in the federal government and getting them to spill all their secrets

[00:22:38] what do you think Russia and China are doing right I mean you think they might have a little bit more

[00:22:43] of a sophisticated and well-funded operation going against our intelligence officers and such

[00:22:49] my goodness the house voted last year to formalize an impeachment inquiry into Joe Biden

[00:22:57] though according to cbs news the effort has largely stalled the effort has largely stalled

[00:23:09] which is weird because I'm literally reading an article in the cbs news

[00:23:15] website here that has all of the details about the latest

[00:23:20] in the impeachment inquiry how has it largely stalled when they have an upcoming hearing

[00:23:29] with members of hunter-biden's business team like all of his partners and stuff they're bringing

[00:23:35] them before the committee you know they're gonna have an open hearing with these guys

[00:23:40] how is this largely stalled no relation to Leslie stalled Pete calendar here thanks a lot for hanging

[00:23:47] out I appreciate it on this same Patrick's Day weekend looking forward to it

[00:23:55] on the lines of the the last story we were going over with the hunter-biden not non-appearance

[00:24:00] in front of the house committee he said he can't be there because he's got to be in court

[00:24:05] out in California well special counsel David Weiss has filed a blistering opposition to the motion

[00:24:16] to dismiss by hunter-biden in california that cites hunter-biden's own book and his conflicting

[00:24:24] statements as creating quote nothing more than a house of cards Jonathan Turley writing at his

[00:24:34] website johnathan turley dot org not dot com although I think he could probably buy it but it's

[00:24:39] like probably thousands and thousands of dollars I think he's got a squatter on his website

[00:24:44] on his name uh weiss's fan filing I should say weiss's filing bulldozes through arguments of selective

[00:24:53] prosecution you'll remember right that uh hunter-biden was saying that he's only being prosecuted

[00:24:59] because his dad is the president you guys are only coming after me because I'm so famous in it

[00:25:05] you're trying to get my dad right that's the like now on the one hand it's a ridiculous argument but

[00:25:11] on the other hand he does kind of have a point right that the only reason that he's facing all

[00:25:19] of these charges is because of his dad and him selling access to if his dad was a nobody right he

[00:25:28] would never have been able to do any of this stuff so I guess to some degree it is true um

[00:25:35] anyway uh the uh the filing from special counsel david weiss

[00:25:43] plows through the arguments of selective prosecution and political influence in the case

[00:25:48] he specifically notes that hunter-biden repeatedly makes statements without any proof or support

[00:25:54] in his filings the filing begins by outright accusing hunter-biden and his lawyer of lying to the

[00:26:01] court about what happened after the whole plea agreement fell apart that was in Delaware right when

[00:26:08] they offered him the sweetheart sweetheart deal and the judge asked hey uh what's with this like

[00:26:16] really sweeping immunity that you're giving hunter-biden for like any future crime any future uncovered

[00:26:23] crime whatever like he's got like I get out of jail free card for the rest of his life what's up

[00:26:29] and then the whole thing fell apart david weiss said that it was hunter-biden's legal team

[00:26:34] that inexplicably shut down negotiations by playing hardball in seeking to preserve the original

[00:26:40] agreement right they tried to pressure weiss and it didn't work in his motion this is what david weiss

[00:26:48] says in his motion in multiple places the defendant falsely states that the DOJ inexplicably demanded

[00:26:55] mr. biden plead guilty to felonies with jail time but he cites nothing in support of his false claims

[00:27:02] which is a consistent theme across his motions his newly invented claim in this motion that the

[00:27:08] government inexplicably demanded that he plead guilty with and do jail time is false it is unsupported

[00:27:15] by evidence and belied by his own letter and representations in his filings in the Delaware case

[00:27:20] so what is what is weiss acknowledging here what is he admitting to hunter-biden is claiming that the

[00:27:27] DOJ demanded he plead guilty to felonies and served jail time and weiss is saying no we didn't

[00:27:38] which is like that doesn't make you look any better david what are you saying so in other words

[00:27:45] the u.s attorney or the special counsel here david weiss there's still not demanding jail time for

[00:27:51] hunter-biden for his gun charge his IRS charges like it's amazing weiss notes that biden repeatedly

[00:28:00] misrepresents facts or claims authority that does not exist he notes that biden does not cite any

[00:28:06] cases of anybody in a similar situation who weren't who was not prosecuted right so if you're

[00:28:13] going to say that you're being selectively prosecuted will show us some examples of other people

[00:28:18] that had the same thing happening to them where they were charged with the same stuff and then
