So last hour we started talking about the Mecklemburg County Sheriff, Gary not my Fault McFadden, although I'm wondering should we include dj DJ not my Fault McFadden because of the whole recording studio that he built in the jail, which, in case you aren't aware of that, he had this recording studio built and then he brought in the media to do like a campaign event, I'm sorry, a an announcement right to show the community all of the good work that he's doing and why he should get re elected. As far as I know, he has not announced his re election plan because he's up for reelection next year. I'm not aware if he has indicated that he is going to run again. I pray that he does not, Please don't run. But they do the big press event, and the guy that they use to hold up as the example of how the inmates are sorry the residents, as he calls them, how the residents are benefiting from the recording studio, was a guy who's in the jail on a murder count. And the Sheriff's office never told the victims family that they were going to be highlighting their son's murderer alleged murder in this puff piece for McFadden, So they happened to turn on the TV and see their son's alleged murder on TV being celebrated and you know, showing off his skills as a rapper or something. And then of course the Sheriff's office had to apologize there was no big fat head shot of not my fault McFadden on that press release. See, they don't put his head shot on the bad when they have to respond to bad press release or have to respond to things with a press release, bad things that they don't put his face on those. But when it's something he wants to tout, like the recording studio, then yeah, he gets the top third of the of the press release with his with his face on it. So now he has another chief deputy who has quit. This guy's name is Chris Allen. He resigned Monday morning. He had replaced Kevin Canty as the second in command after Canty resigned less than a year ago, and Canty called Sheriff Gary McFadden unfit for office. He said he had created a third World dictatorship in the sheriff's office. In his letter, Alan also alleged a hostile work environment, as well as harassment and bullying. I read the resignation letter in the last hour, So if you didn't catch the letter, you can get the podcast in you'll hear what he had to say. It's brutal what he outlines. So McFadden had hired Allan as chief of staff in July twenty twenty four, according to a Facebook post from the Sheriff's office. Allan came from the Union County Sheriff's Office and then he was promoted to interim chief deputy in November after Canty's resignation. So Alan was the chief of staff. So I'm struggling to understand how he did not know that this was the environment when he was there since July of twenty four and then took the promotion Canty's resignation and that eil or that letter. Obviously, everybody in the Sheriff's office has seen that thing. Everybody knows what Kanty was doing. He was doing interviews all over town about it. So you know, this one Texter in the last hour says, this is just disgruntled employees. And I have no doubt that they are disgruntled. The question is are they legitimately disgruntled? Right? Do they have a legitimate reason to be mad at McFadden and the culture of that sheriff's office And not just Canty and not just Allen, but also Maddox, Gina Hicks. Right, there is a whole slew of these former deputies that have all been saying the same thing, and they've been saying it from the very beginning. Remember, McFadden fired people before he even actually took the oath of office. He fired Gina Hicks, who was running the jail Gaston County. Was like, hey, come work for us because she was running the jail. Well. She then ran against him a couple of years later when he was up for reelection and she lost in the last cycle in the Democrat primary. There was another candidate also in that primary, and that's a problem, and the same thing is going to happen here again. I got a text regarding this from JR. You're exactly right. There are currently three other Democrats who have announced that they will be running against McFadden in the Democrat primary election for Mecklemburg County Sheriff. That plays right into McFadden's hands because that will split the vote and McFadden will be elected for a third term. The only way to beat him is to have one very strong candidate to run against him, and it would still be tough to beat him. Yeah, Like, that's the problem is that you've got too many people that keep running, and so you can't have just a one on one race because it's a Democrat primary and you get to have all of these different candidates in the Democrat primary, and then when they go to the general, the Republicans rarely even put somebody up, and if they do, Democrat voters would rather a felon. Not that McFadden's a felon, but this is to the point that Chris made before the newscast. There at the end of the last hour that Democrats elected Jim Black, re elected him despite the impending indictments. Like Jim Black was at the center of several scandals, he went to federal prison, and voters in his district he was from Matthews, I believe, and they still sent him back. Democrats still re elected him rather than elect a Republican. They preferred to have the guy that went to federal prison. So yeah, chances are not good that McFadden can be defeated at the elect at the ballot box here, unless, of course, Democrats are able to clear the field for a strong opponent and then rally around that one opponent, that one candidate to unseat him in the Democrat primary. That's the only way that I think you're going to be able to knock him off. Here's what McFadden stated in a statement that was released following the announcement of this resignation by Chris Allen. Quote. I want to reassure our staff and community that the Mecklimburg County Sheriff's Office remains strong and is committed to its mission. I don't believe you your reassurances don't mean anything. Just by saying that you want to reassure us despite all you're like, you're the meme of the dog sipping coffee in a burning room saying this is all fine. It's not fine. This is not all fine. This is maladministration. I use that word for a reason. The statement then says mcso Metclimber County Sheriff's Office will stay focused on what matters most, serving with integrity, keeping our community safe, and working hard for the people of Meclaburg County. Right, So we can't address any of the stuff personnel matters. We're prohibited by law from discussing any of this stuff. But even after Canty's resignation, McFadden did a couple of interviews. He talked with Brett Jensen from Breaking with Brett Jensen here on WBT, and he's still just not my fault, not my fault. So this doesn't change unless people, specifically Democrats, want this to change. But y'all have to want this to change, and y'all have to do something about it. McFadden is up for reelection next year twenty twenty six. Several candidates have already announced campaigns against him. This is according to wbtv dot com story by Naomi Coles. The the challengers include retired Mecklenburg County Sheriff's Office Chief Deputy Rodney Collins, CMPD Sergeant Ricky Robbins, and a former detention officer named Antoine Nance. This from the Charlotte Observer. Allan made several allegations in his letter, including that McFadden used his position for personal gain. Might want to, uh send a tip to the North Carolina State Auditor, just a heads up on that. Make an anonymous complaint or a tip to the auditor's office, and maybe they could come in and take a look to see if McFadden is requiring staff to go on what are ostensibly campaign events right to improve his standing in the community and look probably nothing to it, but you know, maybe get a set of eyes on it, see what he's actually doing. If there's some actual wrongdoing, then the auditor may be able to sniff that out. But elected officials do this stuff all the time, right, Josh Stein did it with what was it? I'm trying to remember the different campaigns there was like the I think Roy Cooper's deal was the online scams and stuff like that price gouging, right, So they always put out these you know, public service announcements, but they're they're basically campaign material. It's you know, it elevates your profile and you get to use taxpayer funds for the public service campaign, right, to make people aware of scams or whatever. And so maybe that's you know, this what he's going to be able to claim, and that would not surprise me. Alan said that McFadden demands staff attend many events to promote his own agenda and takes people away from their families. He also alleged McFadden asked him to target employees that he had supervised and that he experienced constant bullying when he refused to do that. Okay, So I use this term earlier maladministration, which means bad administration, right, And the reason I use that term is because it is the legal term. According to Article two, Section one twenty eight Dash sixteen North Carolina State law, officers subject to removal any sheriff or police officer shall be removed from office by the judge of the Superior Court. Charges have to be made in writing and then a hearing would be held, and then it lists six call for the removal of any sheriff or officer. Number one wilful or habitual neglect or refusal to perform the duties of the office. I've not heard that as any allegation against macfadden. But number two for wilfulness, conduct, or maladministration in office. Number three is corruption, four is extortion, five is conviction of a felony, and six is for intoxication or upon conviction of being intoxicated. So I don't think any of those other ones apply. I think the only one that you could possibly try to remove him for is maladministration. How do you go about doing this? Well, you can do a petition for removal. The complaint or petition shall be entitled in the name of the State of North ca Carolina, and maybe filed upon the relation of any five qualified electors of the county in which the person charged is an officer. What are five qualified electors? Voters? Those are just voters upon the approval of the County Attorney of such county, or the district attorney of the district, or by any such officer upon his own motion. So you can, I guess, file a complaint against yourself. I don't know why you would do that, but best to cover all the bases. I guess they were thinking when they made this law. It shall be the duty of the county Attorney or district attorney to appear and prosecute this proceeding. See there is a mechanism here. There are several mechanisms. Right. You can go through the judge of the Superior Court, and you can do it after complaints by or petitioned by five qualified electors, and then the county attorney or the district attorney would then have to approve it. Upon the approval, they would then have to appear and prosecute the proceeding. And the judge may suspend the accused from office if in his judgment, sufficient cause appeared from the petition in affidavit which may be presented in support of the charges contained therein. So there is a mechanism if people actually want to try to effect this change. And I like, if you want to start something like that, you would only really need to get four because I'd probably sign it. Not for nothing, I mean, I'm not saying I would charge you for that, like I wouldn't charge you a price. I'm not saying not for nothing, like no price. I'm just saying I would probably sign on to them, and by probably I mean definitely. Here's a great idea. Got a question, is sheriff not my fault McFadden cooperating with ICE now per the new law. Well, it's funny you mentioned that because the other day we got a press release from the Sheriff's office, and this one has his face on it. So it's something that he wants coverage for in a positive way, because if it's a negative story that he's responding to, then they don't put his face on those. They put his big face on like the top third of the sheet. Anyway, they put out this press release, and you'll forgive me if I read it sort of haltingly, because it's not like a document where you can just print it and read it. It's an image. So they type this thing up and then they send it as an image because again, the top third of the page is his face and then the next part is text, but you can't just capture the text. I'm not going to print his face out. I'm not doing it. I'm not printing out a page with the black background and the green and all the colors and stuff in that huge photo of him. Like, I'm not going through Toner just to print out this press release. And if you try, the text is super small. So that's what I did. A screenshot of it. I blew it up, and so it's kind of anyway. Sorry, I'm just letting you know why I'm reading it the way I might be reading it, because I'm a professional. I want there to be an excuse, I mean, an explanation. Okay, here's what he said about the immigration topic. I am publicly reaffirming that Mecklenberg County is not classified as a quote sanctuary county. Following the Department of Justice's most recent publication of sanctuary jurisdictions on August five, twenty twenty five, the DOJ's list published pursuant to Executive Order one four two eight seven called the Protecting American Communities from Criminal Aliens Order. The list identifies jurisdictions with policies that impede enforcement of federal immigration laws. Meckelmberg County's absence from this list confirms its compliance with federal standards while continuing to focus on local public safety priorities. Okay, number one, the reason why he is now in compliance is because the state legislature has had to pass I think now at this point we are up to three different laws. The General Assembly has had to pass two or three three laws over the last three years specifically to get these sheriffs that have not been fully cooperating with ICE to get them to do so. So now he benefits by not being on the list because the Republican legislature forced him to do what every other sheriff in the state had been doing, Like ninety five of the one hundred sheriffs were cooperating with ICE fully. He and several others like in Wake County, Durham County, oh Bunkham County, there's like five of them that have not been fully cooperating, and they were turning these illegal aliens loose, and they were being accused of being sanctuary sheriffs, and he is always very sensitive to that. He didn't like that allegation. So now that the list comes out for these cities and states and counties that continue to not cooperate with ICE. There aren't any North Carolina locations on the list because the General Assembly has now made sure that these sheriffs have to help with ICE. He goes on to say, he has made it his duty to ensure the public receives verifiable facts, not assumptions about our policies and practices. Okay, they're not assumptions. You ran on a campaign of abolishing the two eighty seven G program. That was your campaign promise that you were not going to cooperate with ICE. And then he kept saying, oh that they give me a warrant signed by a judge. But a warrant is issued for criminal activity. The ICE detainers are specifically for immigration violations, which lead to the removal from the country possibly right, So it's a different standard. One is civil, one is criminal. And he's demanding a criminal warrant for a civil infraction, and he ran again on an explicit promise to stop cooperating with ICE. Here is what the US Immigration and Customs Enforcement at Atlanta office director John Tucaris told Spectrum News six years ago. Criminal federal warrants are only issued in criminal proceedings not immigration proceedings, which are civil. So when they ask for a criminal arrest warrant to pick up an individual, it does not exist in immigration proceedings. So they are really asking for something that ICE cannot get, something that there's no requirement and no judge can issue for immigration purposes. That's the game that McFadden was playing until the state legislature closed these loopholes. He goes on to say, for years, lawmakers and certain media outlets have tried to paint Mecklumberg County as a so called sanctuary jurisdiction, repeatedly using the word cooperation with Immigration and Customs enforcement almost exclusively in reference to the Mecklinberg Sheriff's office, and not when I am seeking that same level of cooperation from ICE, as if it were a label meant only for Mecklinberg. Yes see again, he's the victim. He refused to call ICE. That's why they just did the last law. They just did a law saying you've got to contact ICE, because this was his latest loophole he was exploiting, where it's like, well, you know, it just says, you know that we got to let you know that the person's in the jail, but we didn't have to give you the call when when they're bailing out, and now it's like, Okay, Gary, now you have to call. Okay, you got to do this. Yeah, full cooperation with ICE, but he's always demanding that ICE fully cooperate with him by giving him if a federal warrant or something like. Guys, you ran on a campaign of not cooperating with ICE. You can't be all butt heard when people say you're not fully cooperating with ICE. I don't think he's smart enough to come up with these plans for twisting the laws. They pay him and then write these statements. Well I know, I think yes and no. I think that there are attorneys that are working behind the scenes. I have no proof of this, but this is my guess that have been advising different law enforcement agencies on how to not comply with the immigration laws. Right, So they I'm sure that they are giving them the guidance that they then rely on to obstruct right, and they may have exhausted all of those options. I don't know. I asked when we had Destin Hall, the Speaker of the House, on and I asked him, are we sure that you guys closed all these loopholes now, and he seemed confident that they had. So we shall see. As for the statements the press release stuff, I think that is his office that writes this stuff up, and they probably rely on some guidance from those attorneys. Related to the illegal immigration topics, Senate Judiciary Chairman Chuck Grassly yesterday released new data from the Department of Health and Human Services which confirmed his concern that the Biden administration placed more than ten thousand migrant children with unvetted sponsors. These requests for the data were ignored or stonewalled by the previous administration, which should come as a shock to exactly nobody. The data shows that the Office of Refugee Resettlement between January twenty twenty one through January twenty twenty five, so Biden's term is four years, this office placed eleven thousand, four hundred eighty eight unaccompanied migrant children with unvetted sponsors who were not their parents and were not their legal guardians. During that same four year period, the department also declined to conduct home studies for over seventy nine thousand migrant children under the age of twelve, including in homes where a study was actually recommended, but they didn't do it. Obviously, to anybody with half a brain sees the implications here that you can have human traffickers taking guardianship of these kids because the guardians have not been vetted. Grassley said, it's appalling to prioritize speed and optics over the safety and well being of children. He's exactly right. The Trump administration has since moved to reform the unaccompanied minor program, including launching an interagency initiative and investigation back in February into the suspected fraud and trafficking of the program. Also Secretary of Transportation Sean Duffy out with a statement. He posted this up on Twitter formerly known as x This is about the launching of an investigation into the White Hawk carrier accident. This illegal alien driver of a semi who made an illegal U turn in the middle of an interstate. He used one of those emergency turnoff lanes or where cops can make the U turn, and he he just hung a left and like went to turn the truck around, and he's got a like we've seen the footage from inside his cab and he makes the turn and you know, a car traveling at you know, seventy miles an hour right behind him plows into his UH into the trailer because you don't expect to see a tractor trailer just hang a left across the interstate and it killed the three people in the car. And according to Duffy, Washington State improperly issued this driver a full term CDL. Asylum seekers or illegal aliens are not allowed to receive a full term CDL. New Mexico failed to conduct an English language proficiency test when they pulled him over for speeding. Had they done this, the driver would not have been on on the road, and the Transportation Department is also looking into California's issuance of his CDL as well. He says states must follow the rules. If they had, this driver would never have been behind the wheel and three precious lives would still be with us. The failures here are despicable. Non enforcement and radical immigration policies have turned the trucking industry into a lawless frontier, resulting in unqualified foreign drivers improperly acquiring licenses to operate forty ton vehicles. The President and I moved quickly to require drivers to speak English national language and launch a full scale audit of how these licenses are doled out. All of this is just the tip of the iceberg.
