Charlotte judges suspend more sentences for violent offenders (07-26-2024--Hour2)

In Mecklenburg County, shooting into an occupied vehicle or dwelling will get you a suspended sentence and probation. And for some reason, local officials are perplexed why the violent crime rate is high.

And they send out press releases as, like, that's not really surprising, but they send out press releases as they are known to do. And the other day they sent one out about their violent crimes team and the disposition of the state.

[00:00:58] disposition of a number of the cases. And they do this regularly, by the way. And usually, I mean, a lot of times it gets caught in my spam folder, so I end up deleting it accidentally, but I do try to read them. And so, but I, and I've read one before a couple of weeks ago. So I got one a couple days ago, and I thought as a public service, I would relay to you the disposition of about a dozen trials that occurred.

[00:02:02] John Curiton, John Curiton, Jacqueline Grant, David Strickland. They list all the judges, okay? So here's the judge's name that, I don't know, just something seemed a bit off when I was reading through the press release.

[00:02:16] Jacqueline Grant.

[00:02:18] Judge Grant.

[00:02:21] So, first up, we've got the case of Davion Reed.

[00:02:30] 20 years old.

[00:02:32] Tried for robbery with a dangerous weapon.

[00:02:34] The jury returned a verdict of guilty as charged.

[00:02:37] Judge Strickland sentenced Reed to 51 to 74 months in prison.

[00:02:43] So, that's like almost, what, five years, right?

[00:02:46] A little bit over four, but all the way up to six.

[00:02:49] So, four to six years, I guess.

[00:02:51] They do it by months.

[00:02:52] So, 51 to 74 months.

[00:02:54] Next up, Jahani McMillan.

[00:02:59] Jahani?

[00:03:00] I don't know.

[00:03:01] It's J-H and then apostrophe and then A-N-E.

[00:03:19] Anyway, this person, 25 years old, tried for discharging a firearm into an occupied vehicle.

[00:03:26] The jury returned a verdict of guilty as charged.

[00:03:30] Oh, all right, good.

[00:03:32] So, two for two so far.

[00:03:33] Good job, Mecklenburg juries.

[00:03:35] Discharging a firearm into an occupied vehicle.

[00:03:38] Guilty as charged.

[00:03:39] At the sentencing hearing, the state sought an active prison sentence.

[00:03:44] In her discretion, Judge Jacqueline Grant imposed a suspended sentence.

[00:03:52] 23 to 40 months.

[00:03:55] So, between two to three years.

[00:04:00] But suspended.

[00:04:02] On the condition that Jahani McMillan successfully complete 36 months of supervised probation.

[00:04:12] So, this 25-year-old shot a firearm into an occupied vehicle.

[00:04:23] I'm not sure there's a good version of that story.

[00:04:26] Like, just those details I've given you, I'm not sure there's a better version of that story besides what I'm conjuring up in my head, which is people in a car, maybe a road rage incident, or drug deal gone bad, or words exchanged.

[00:04:41] You insulted me, disrespected me, whatever.

[00:04:45] Into an occupied vehicle.

[00:04:46] Apparently didn't kill anybody, but discharged a firearm into an occupied vehicle.

[00:04:51] The jury convicted this person of that charge, and the judge suspended the sentence.

[00:04:57] No jail time.

[00:04:59] I wonder why we get people firing weapons into cars.

[00:05:04] Anyway, next up.

[00:05:06] Israel Johnson.

[00:05:18] Charged for possession of a firearm by a convicted felon.

[00:05:22] Resisting a public officer.

[00:05:27] Not guilty to the firearm charge, but guilty.

[00:05:31] To the resisting a public officer.

[00:05:34] The judge sentenced Johnson to 45 days in jail.

[00:05:38] Suspended.

[00:05:39] That judge was Archie.

[00:06:19] Pled guilty.

[00:06:20] Six counts of robbery with a dangerous weapon.

[00:06:22] Two counts of attempted robbery with a dangerous weapon.

[00:06:25] Judge Strickland sentenced Belton to a total of 80 to 120 months in prison.

[00:06:31] Judge Strickland.

[00:06:33] David Strickland.

[00:06:34] Good job, David Strickland.

[00:06:37] Because that's what?

[00:06:39] Six to 10 years in prison for six counts of robbery with a dangerous weapon and two counts

[00:06:45] of attempted robbery with a dangerous weapon.

[00:06:46] Yeah, this guy's a menace.

[00:06:51] Pleaded guilty.

[00:06:52] Two.

[00:06:53] Discharging a firearm into occupied property and larceny from that person.

[00:07:02] Sentenced Knight to 20 to 36 months in prison.

[00:07:07] But, that's right everybody.

[00:07:09] That sentence was suspended.

[00:07:12] On the condition that Knight successfully complete 36 months of supervised probation.

[00:07:18] But, hang on, there's a special provision here.

[00:07:22] He has to do 20 days in jail.

[00:07:26] 20 days in jail for a game.

[00:07:29] So, this Judge Grant, apparently not a big opponent of shooting into occupied property.

[00:07:38] Whether it's a house or a car.

[00:07:40] Doesn't really matter to her, it seems.

[00:07:43] Next up, we got Jordan Johnson.

[00:07:45] 22.

[00:07:46] He pled guilty to assault with a deadly weapon inflicting serious injury and robbery with a dangerous weapon.

[00:07:51] He got sentenced by Judge Johnson.

[00:07:54] Let's see.

[00:07:55] That is...

[00:08:24] Pled guilty to assault with a deadly weapon.

[00:08:26] Tavion Wells.

[00:08:28] 26.

[00:08:29] Pled guilty to robbery with a dangerous weapon.

[00:08:32] Four counts of assault by pointing a gun.

[00:08:34] Archie, Judge Archie, sentenced Wells to 54 to 77 months.

[00:08:38] Good job on that one, Archie.

[00:08:41] Archie also sentenced another one who pled felony, guilty to a felony hit and run.

[00:08:45] They got two years in prison.

[00:08:48] Markel Parker, 25.

[00:08:50] Pled guilty to conspiracy to commit discharging a firearm into an occupied vehicle in operation.

[00:08:57] Oh, so that sounds like it was moving at the time.

[00:09:01] This is Judge McKnight.

[00:09:02] Reggie McKnight, a Superior Court judge.

[00:09:06] Judge McKnight sentenced Parker to 20 to 36 months in prison.

[00:09:11] But suspended.

[00:09:14] Suspended.

[00:09:15] If you do probation for 24 months.

[00:09:18] So once again, another discharging a firearm into an occupied vehicle.

[00:09:24] You get suspended sentences.

[00:09:28] Justin Johnson.

[00:09:30] Another Johnson.

[00:09:31] 20.

[00:09:31] Pled guilty to discharging a firearm into occupied property.

[00:09:35] Possession of a weapon of mass destruction.

[00:09:37] That sounds bad.

[00:09:39] Our pal Judge Jacqueline Grant sentenced him to 31 to 50 months in prison.

[00:09:47] But suspended the sentence pending 36 months of supervised probation.

[00:09:53] But, as part of the sentence, the defendant must serve seven months in prison.

[00:09:57] And upon completion of that sentence, the defendant will be placed on six months of house arrest.

[00:10:02] So once again, discharging a firearm into occupied property.

[00:10:06] Not that big of a deal.

[00:10:08] And Larry Bethea pled guilty to possession of a firearm by a convicted felon carrying a concealed gun as well.

[00:10:16] Judge Grant sentenced Pathea 13 to 25 months in prison.

[00:10:23] But that sentence was suspended pending the defendant's successful completion of 30 months of supervised probation.

[00:10:29] I am sensing a pattern here with Judge Jacqueline Grant.

[00:10:37] Remember, this stops when you want it to.

[00:10:42] So, Amy sends me a tweet.

[00:10:45] It's a Pete tweet, she says.

[00:10:46] Which, by the way, that's one of the reasons why I'm refusing to call it X.

[00:10:51] Because Pete tweet is way better from a branding perspective.

[00:10:55] So, Amy says, shooting into occupied property sounds a lot like attempted murder to me.

[00:11:02] But then, I'm not a lawyer or a judge.

[00:11:05] Yeah.

[00:11:06] That's what it kind of sounds like to me, too.

[00:11:08] There's a person in the occupied property, right?

[00:11:14] It's right there in the description.

[00:11:18] Somebody is inside.

[00:11:19] And you shot into that inside.

[00:11:36] But it sounds like that could be attempted murder.

[00:11:40] Maybe these are the plea deals.

[00:11:43] Because a lot of those crimes that I just read,

[00:11:46] the disposition of those crimes from the DA's office,

[00:11:48] a lot of them were that the defendants pleaded guilty.

[00:11:52] And so you pleaded guilty because you're avoiding a trial.

[00:11:57] Why?

[00:11:57] Because there's so much evidence.

[00:11:58] And usually they throw a whole bunch of charges at you.

[00:12:01] And then you agree to some of the lower charges.

[00:12:04] And part of the plea deal sounds like you get suspended sentences.

[00:12:09] Isn't that lovely?

[00:12:11] Don't you do that again.

[00:12:15] So, yeah.

[00:12:16] I'm just reading between the lines there.

[00:12:17] I don't know for sure.

[00:12:18] I'm just going by what the DA puts out in their press release.

[00:12:25] But good for them for the couple of jury trials that they did score convictions on.

[00:12:31] Unlike what's going to happen up in Washington, D.C., I'm sure,

[00:12:34] where a whole bunch of anti-Israel protesters got arrested

[00:12:39] and had all of their misdemeanor charges dropped yesterday.

[00:12:43] One day after they, you know, vandalized monuments, federal property,

[00:12:50] they burned an American flag.

[00:12:53] The charges for 11 protesters who had their cases dropped included

[00:12:58] crossing police lines and disorderly conduct

[00:13:01] at the protest that was attended by thousands in Washington on Wednesday.

[00:13:06] That according to the Washington Attorney General's Office.

[00:13:10] Additionally, at least six people charged by the U.S. Attorney's Office in Washington

[00:13:15] were released pending their court hearing.

[00:13:17] According to Washington Superior Court records obtained by the Washington Examiner,

[00:13:22] which is where I'm reading this.

[00:13:24] It's a piece by Kalan Deese.

[00:13:27] Kalan Deese.

[00:13:29] Okay.

[00:13:29] The protesters, given release conditions,

[00:13:33] face charges such as assault on a police officer,

[00:13:37] attempted assault with a deadly weapon,

[00:13:39] making threats,

[00:13:40] and attempted second-degree theft.

[00:13:42] And they have been issued a stay-away order

[00:13:46] to avoid the Union Station grounds

[00:13:48] until they head to preliminary hearings in late August.

[00:13:52] Or else...

[00:14:01] What happens if they don't stay away from Union Station grounds?

[00:14:05] Oh, then we're really going to be mad at you.

[00:14:10] Altogether, there were 23 total arrests made on Wednesday

[00:14:13] in connection to the demonstrations

[00:14:14] against Israeli Prime Minister Benjamin Netanyahu's speech to Congress.

[00:14:21] The protests involved thousands

[00:14:23] and led to tense confrontations with police.

[00:14:26] More than 1,424 defendants have been charged, by the way,

[00:14:32] just for comparison,

[00:14:33] 1,424 charged since the January 6th protest.

[00:14:41] About 350 people from that event were charged with assaulting,

[00:14:45] resisting, or impeding officers or employees,

[00:14:48] including about 110 who used a deadly or dangerous weapon

[00:14:53] to cause serious harm to a law enforcement officer.

[00:14:56] At least 145 people have been sentenced to prison terms

[00:15:00] over 151 months,

[00:15:03] and roughly 172 defendants have been sentenced

[00:15:06] to periods of home detention,

[00:15:07] including about 30 who were sentenced

[00:15:09] to a period of incarceration.

[00:15:13] Kenneth Spencer is the chairman of the Park Police Union,

[00:15:18] and he attributed the limited number of arrests

[00:15:20] to staffing and resource constraints.

[00:15:24] It's almost as if there may have been

[00:15:30] some sort of a policy decision somewhere along the line

[00:15:37] to, there's a word for it,

[00:15:40] like reduce the money paid to law enforcement.

[00:15:46] There's a term, ah, man, it'll come to me.

[00:15:50] There's a, oh, that's right, defund the police.

[00:15:53] That's right, yes, defunding the police.

[00:15:56] And now they don't have enough police

[00:15:59] to not just police a riot or protest,

[00:16:03] but they don't have enough police to catch the people

[00:16:06] to then get them in front of judges

[00:16:09] who will then, like, let them go.

[00:16:11] So, yeah, it's a system failed,

[00:16:14] as Brett Winterbull might say.

[00:16:15] The system failed after we starved out of money.

[00:16:20] He says, Pete, one of the hardest positions to vote for

[00:16:23] is that of judges.

[00:16:25] The reason being, the public rarely gets updates

[00:16:28] to what judges do, like you are giving today.

[00:16:31] These judges get reelected

[00:16:33] because nobody really knows much about them.

[00:16:35] I sincerely appreciate this information on the judges,

[00:16:38] which I will write down and make sure

[00:16:40] that they do not get my vote.

[00:18:39] and then Joe Biden dropped out.

[00:18:46] he had to leave the race entirely.

[00:18:52] the Trump campaign issued a statement.

[00:18:57] the Trump campaign communications director,

[00:19:01] said, quote,

[00:19:02] given the continued political chaos surrounding crooked Joe Biden and the Democrat Party,

[00:19:08] general election debate details cannot be finalized until Democrats formally decide on their nominee.

[00:19:14] There is a strong sense by many in the Democrat Party,

[00:19:18] namely Barack Hussein Obama.

[00:19:20] Mm, mm, mm.

[00:19:21] I threw in the mm, mm, mm part.

[00:19:23] But he used the full name.

[00:19:25] But there is a strong sense by many in the party that Kamala Harris is a Marxist fraud

[00:19:31] who cannot beat Trump,

[00:19:32] and they are still holding out for somebody better.

[00:19:35] Therefore,

[00:19:36] it would be inappropriate to schedule things with Harris

[00:19:39] because Democrats very well could still change their minds.
